Privacy and data protection (GDPR)
SK ateliér processes personal data only to the extent necessary to prepare and carry out architectural and building design services and to administer the associated commission. This notice describes processing under Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
Data controller and contact details
The data controller is Ing. Stanislav Kroulík, business registration number 72933828, with a registered address at Dolská 210, 538 54 Luže, Czech Republic. For matters relating to personal data protection, you can contact him at kroulik@centrum.cz or write to the registered address.
Purposes and scope of processing
We use personal data to discuss a project commission, prepare and perform a contract, produce concept designs and design documentation, and arrange the associated approvals and permits. Where included in the commission, this also covers representing the developer under a power of attorney, submitting applications, obtaining the necessary statements and binding opinions, and arranging a building permit or related procedures.
We primarily process names, contact and correspondence addresses, telephone numbers, email addresses, necessary contractual and billing information, and details of a person's relationship to a building or property. Identification details required for a particular submission and information contained in powers of attorney, consents, project documents or official records are processed only where necessary for the commission and the relevant procedure. This may also include necessary data about owners of affected properties, representatives and other people involved in preparing or obtaining approval for the project.
We obtain data from the client and other people concerned, from documents supplied for the commission and, where necessary, from public registers such as the land register or from the relevant authorities. Public availability does not permit unrestricted use of the data. We do not use personal data for advertising mailings, sell it, or carry out automated decision-making or profiling.
Legal basis
We primarily process client data to take steps towards a contract at the client's request and to perform that contract (Article 6(1)(b) GDPR). Where processing is required by law, for example for accounting or mandatory retention of documentation, the legal basis is compliance with a legal obligation (point (c)). For necessary data about other people concerned and for protecting legal claims, the basis may be our legitimate interest in properly preparing and obtaining approval for a project or protecting legal rights (point (f)), always taking account of those people's rights. We do not require blanket GDPR consent for processing on these grounds.
Providing the data needed for a contract or a particular administrative procedure is necessary to complete the relevant part of the commission. Without it, we may be unable to prepare documentation, submit a complete application or arrange a building permit.
Disclosure to authorities and other recipients
Where necessary, we disclose data to the relevant building authorities, statutory consultees and other public authorities so that a proposal can be considered, the necessary statements and opinions obtained, and a building permit or other project-related procedures completed. Depending on the commission, necessary data may also be disclosed to owners or operators of utility and transport infrastructure and other parties whose input or cooperation is required.
Specialist designers and other collaborators may contribute to a commission. Providers of accounting, email and technical services may also have access to necessary data. We disclose only the data required for a specific purpose; authorities and other independent controllers subsequently handle it in accordance with their statutory obligations. Project documents are not intended for public disclosure on this website.
Retention periods
We retain data while preparing and carrying out a commission and completing the related project approval procedures. After that, we retain it only for the period required by law for the relevant records or documentation, or as necessary to protect legal claims. The period depends on the type of document, statutory retention obligations and applicable time limits for bringing claims. Data relating to an enquiry that does not lead to a commission is kept only as long as needed to deal with it and any follow-up communication.
